You need a permit if:

1.      The property is in any of the overlays. If you are looking to have work done on the Significant Landscape Overlay (SLO), Environmental Significance Overlay (ESO) or the Vegetation Protection Overlay (VPO), then you will need a permit. Some of the properties governed by these overlays may fall in the areas of the Yarra River around Kew, Balwyn North, and Hawthorn. You can find out if your property falls in these Overlays by going to the Planning Schemes Online site.

2.      The tree in question is a significant tree or a canopy tree that is protected by law (Check out Boroondara’s Tree Protection Local Law)

FOR YOUR INFORMATION: These trees may have high holding value and could be registered on the Significant Tree Study. You are welcome to call Boroondara City Council at (03) 9278 4888 or go to http://www.boroondara.vic.gov.au/our-city/trees/tree-works-permits to check if you have any Significant Trees.

A Canopy Tree is one that has a measurement around A, B, C that is larger than 110 cm and is 1.5m above ground.

Exceptions to the rules:

If you feel the need to prune your trees, you can do so without getting a permit if you are taking off less than 25% of the foliage. The job must meet the Australian Standards (AS 4373-2007). You will need to find a tree specialist to help you know how certain trees do with pruning and what the long-term effects, if any, will be.
